1. Fees and Payments
1.1 Fees for Services:You agree to pay to Swimspire any fees for each Service you purchase or use in accordance with the pricing and payment terms presented to you for that Service. Where applicable, you will be billed using the billing method you select through your account management page. Fees paid by you are non-refundable, except as provided in these Terms or when required by law.
1.2 Subscriptions:Some of our Services are billed on a subscription basis (we call these “Subscriptions”). This means that you will be billed in advance on a recurring, periodic basis (each period is called a “billing cycle”). Billing cycles are typically monthly or annual, depending on what subscription plan you select when purchasing a Subscription. Your Subscription will automatically renew at the end of each billing cycle unless you cancel your subscription through your online account management page, or by contacting us. While we will be sad to see you go, you may cancel your Subscription at any time, in which case your Subscription will continue until the end of that billing cycle before terminating. You may cancel your Subscription immediately after the Subscription starts if you do not want it to renew.
We reserve the right to suspend or terminate your subscription or product for any reason, with or without notice and without further obligation. You will not be entitled to a refund in these circumstances. If any or all of our digital products are temporarily unavailable, you will not receive a refund. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
3. Medical Disclaimer
By registering with Swimspire, you agree to consult your physician before engaging in the exercises depicted on the website, or suggested by the coaches at Swimspire. This is especially important if you have any of the following symptoms or conditions, including (but not limited to): high blood pressure, obesity, heart problems, diabetes, a family history of heart disease, chest pains, high cholesterol levels, major surgery, acute illness, or a history of smoking.
The advice contained on the Swimspire website or given by Swmspire coaches is not intended to be used by those under 18 years of age, those new to regular exercise, those who have diagnosed illnesses which preclude them from exercising, and those whose lifestyle or family history is known to predetermine them to sudden cardiac episodes or other exercise-related medical problems.
By registering with Swimspire, you agree that you are physically fit and able to engage in swimming exercises.
You should understand that when participating in any exercise or exercise program, there is the possibility of physical injury. If you engage in this exercise or exercise program, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself and agree that Swimspire assumes no responsibility for personal injury or property damage sustained by or through the use of this website.
You acknowledge, understand and agree that the advice given on the Swimspire website is in no way intended to be a substitute for professional medical advice. Swimspire is not a licensed medical care provider and represents that it has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition. Discontinue any exercise that causes you pain, severe discomfort, nausea, dizziness, or shortness of breath and consult a medical expert. Start slowly and at the level that is appropriate for you. Not all of the drills or exercises depicted on the Swimspire website are suitable for everyone.
